Did not yet check the whole theme for XHTML strict validation, but for now there are multiple errors when validating, the most come from comment declarations.

we never claimed our theme is 100% XHTML valid
Although there is no broken or not-semantic markup, we do not pass some XHTML cases (such as the comments you mentioned and the target attribute of the links for example), and we don’t think it is an issue at all.
